FAFCU Member Referral Promotion Terms and Conditions

Promotion Period

Forest Area Federal Credit Union ("FAFCU") is offering the Member Referral Promotion (“Promotion”). The Promotion begins at 12AM EDT on 9/1/2026 and ends at 11:59 PM EDT on 10/31/2026 (the "Promotion Period"). By participating in the Promotion, members and new member referrals (“Promotion Participants”) are bound by these Terms and Conditions (“Terms”) and are indicating their agreement to abide by these Terms. All of FAFCU’s decisions with respect to the Promotion and/or any referral consideration or reward thereunder shall be final and binding.

Who May Participate

The referring member must be at least 18 years of age, and an existing FAFCU member in good standing when the referral is submitted and when the referral reward is paid. The referred person must be at least 18 years or older, eligible for FAFCU membership, and must not have been an FAFCU member during the six months immediately preceding the referral. Membership and account opening for referred persons are subject to identity verification, account approval, FAFCU membership eligibility requirements*, and terms of the FAFCU Membership and Account Agreement as well as all applicable account disclosures.

*The field of membership shall be limited to having the following common bond: Persons who live, work, worship, or attend school in, as well as businesses and other legal entities located in the following counties: Alcona, Alpena, Antrim, Arenac, Benzie, Charlevoix, Cheboygan, Chippewa, Clare, Crawford, Emmet, Gladwin, Grand Traverse, Iosco, Kalkaska, Lake, Leelanau, Mackinac, Manistee, Mason, Missaukee, Montmorency, Ogemaw, Osceola, Oscoda, Otsego, Presque Isle, Roscommon, or Wexford Counties, Michigan.

How a Referral Is Credited

The referral must be submitted through an approved FAFCU referral card or online referral form before or at the time the referred person opens the new membership. A referral cannot be added after account opening.

Maximum aggregate new member reward limit: $300. The reward structure:

Existing members may earn $50 for each qualifying referral, with no stated referral cap, subject to these Terms.

Account and Qualification Requirements

Regular Share Account. A $10 minimum opening deposit and $10 minimum balance are required to establish and maintain membership. The account and membership must remain open and in good standing through reward payment. The referred person receive $50 if eligible to open an account, and does so within the promotion terms.
Superior Checking Account. No minimum opening deposit is required. To earn the additional $200 reward, the new member must achieve Qualified Dividend Status for at least one qualifying monthly cycle during the first 60 days after the Superior Checking Account is opened. The referred person receive $50 if eligible to open an account, and does so within the promotion terms.
Qualified Dividend Status: To qualify, members must complete ALL of the following requirements.
Complete at least 10 debit card transactions
Sign on to online banking at least 4 times
Have a direct deposit of at least $100
Be enrolled in e-statements

Annual Percentage Yield and Minimum-Balance Disclosures

Regular Share Account: $10 minimum opening deposit and balance.

Superior Checking Account: 5.12% APY*, (or) 8% PROMOTIONAL APY* during promotional dates of 9/1/2026-12/31/2026, no minimum opening deposit, $15,000 maximum balance to earn dividends. APY = Annual Percentage Yield. Dividends paid out monthly. APYs are variable and may change after account opening. Fees may reduce earnings. See FAFCU’s current Rate Schedule and applicable account disclosures.

*Annual Percentage Yield. Membership required for deposit accounts. Superior Checking requirements must be met to receive dividends. Rates Subject to change without notice.

General Terms & Conditions

Promotion rewards are paid only after FAFCU verifies all requirements in its sole discretion. The applicable FAFCU accounts and memberships must remain open and in good standing through the reward payment date. FAFCU may deny a reward associated with fraud, abuse, inaccurate information, or failure to satisfy these Terms. One new-member reward package is available per eligible new member referral.

Promotion rewards may constitute taxable income. Each recipient of an award is responsible for any federal, state, or local tax liability. FAFCU will report payments to applicable tax authorities via tax forms as required by law.

Promotion Participants must be natural persons with whom the member has at least a passing acquaintance. Members may not solicit strangers for referrals. Members may not solicit referrals through any non-FAFCU endorsed websites. Members may not create multiple, fictitious, or fake accounts with FAFCU or participate in the Promotion as a new member referral. Members may not use the Promotion to violate any law, infringe or violate the rights of any third party, or otherwise act in a manner that is deemed harassing, harmful, illegal, hateful, obscene or outside the spirit and intent of the Promotion. In addition, members may not (i) tamper with the Promotion, (ii) act in an unfair, abusive, deceptive or disruptive manner, or (iii) use any unauthorized system, bot or other device or artifice to participate or receive any benefit in the Promotion. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, FAFCU RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY FEES) TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.

PROMOTION PARTICIPANTS UNDERSTAND AND AGREE THAT THE RELEASED PARTIES (DEFINED BELOW) SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF FAFCU WAS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES). By participating in the Promotion, members and referred persons agree to defend, indemnify, release and hold harmless FAFCU and its affiliates and subsidiaries, employees, directors, officers, licensees, licensors, shareholders, attorneys and agents including, without limitation, its advertising and promotion entities, and any person or entity associated with the production, operation or administration of the Promotion (collectively, the “Released Parties”), from any and all claims, actions, demands, damages, losses, liabilities, costs or expenses caused by, arising out of, in connection with, or related to the Promotion (including, without limitation, any property loss, damage, personal injury or death caused to any person(s)) and/or the awarding, receipt and/or use or misuse of any benefit in the Promotion). For the avoidance of all doubt, the Released Parties shall not be liable for any technical errors or malfunctions, data theft or corruption, any printing or typographical error, or any damage to any computer system resulting from participation in, or the accessing or downloading information in connection with the Promotion. The Released Parties shall not be liable to any users for failure to supply any advertised benefit, by reason of any acts of God, any action or request by any governmental or quasi-governmental entity (whether valid), or any other activity or action that is beyond any of the Released Parties’ control. TO THE FULLEST EXTENT POSSIBLE BY LAW, THE RELEASED PARTIES’ MAXIMUM LIABILITY ARISING OUT OF OR IN CONNECTION WITH THE PROMOTION, REGARDLESS OF THE CAUSE OF ACTION (WHETHER IN CONTRACT, TORT, BREACH OF WARRANTY, OR OTHERWISE), WILL NOT EXCEED $100.

PROMOTION PARTICIPANTS EXPRESSLY UNDERSTAND AND AGREE THAT: (A) THE PROMOTION IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS AND FAFCU EXPRESSLY DISCLAIMS ALL WARRANTIES, CONDITIONS AND TERMS OF ANY KIND, WHETHER EXPRESS OR IMPLIED BY STATUTE, COMMON LAW OR CUSTOM, INCLUDING, BUT NOT LIMITED TO, WARRANTIES AS TO PRODUCTS OR SERVICES OFFERED THROUGH THE USE OF THE PROMOTION, IMPLIED WARRANTIES OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT; (B) THE RELEASED PARTIES MAKE AND GIVE NO WARRANTY THAT (i) PARTICIPANTS WILL MEET PROMOTION PARTICIPANT REQUIREMENTS, (ii) THE PROMOTION WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, AND (iii) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL OBTAINED BY PROMOTION PARTICIPANTS THROUGH THE PROMOTION WILL MEET EXPECTATIONS, AND (C) ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE PROMOTION IS ACCESSED AT THE PROMOTION PARTICIPANT’S OWN DISCRETION AND RISK, AND PROMOTION PARTICIPANTS WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO THEIR COMPUTER SYSTEM OR MOBILE DEVICE OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OR USE OF ANY SUCH MATERIAL.

Mass Solicitation by Referrer Prohibited; Indemnification

Referrals of new members must be created and distributed in a personal manner that is appropriate and customary for communications with friends, colleagues, and family members. Mass solicitation, solicitation of strangers or persons who are not a member’s friends, colleagues and family members, or any other use of the Promotion described herein in a manner that is not promoted is expressly prohibited and may be grounds for immediate termination and further legal action. Referrers who do not comply with applicable law are obligated to indemnify the Released Parties against any liabilities, costs, and expenses it incurs as a result of same.

Right to Cancel, Modify or Terminate

Promotion rewards cannot be combined with any other account opening offer. FAFCU reserves the right to amend, modify or revise these Terms at any time. FAFCU further reserves the right to cancel, modify or terminate the Promotion at any time for any reason. FAFCU further reserves the right to disqualify any participant at any time from participation in the Promotion for failure to comply with any of these Terms or any other reason in its sole and absolute discretion. Terms and conditions subject to change without notice. FAFCU reserves the right to decline any referral request that originated in a manner not in compliance with the letter and spirit of these Terms.

Binding Arbitration and Class Action Waiver

All issues and questions concerning the Promotion, these Terms, the rights of the participants in connection with the Promotion, any dispute arising between FAFCU and any participant and/or any dispute concerning the administration of the Promotion shall be governed by and construed in accordance with the laws of the state of Michigan and applicable Federal law, and shall further be subject to the Resolution of Disputes by Arbitration and Class Action Waiver contained with the FAFCU Membership and Account Agreement.

Referral Information and Privacy

Do not submit Social Security numbers, account numbers, login credentials, or other sensitive personal information through a referral card or referral form. If a referring member provides another person’s contact information, the referring member represents that the person has authorized the information to be shared with FAFCU. Submission of a referral does not guarantee membership or account approval. The personal information collected, processed, and used as part of the Promotion will be used in accordance with FAFCU’s Privacy And Security Policy, which is available on our website. By participating in the Promotion, all participants agree to FAFCU’s use of their personal information and acknowledge that they have agreed to be bound by FAFCU’s Privacy And Security Policy.
